Court Order certifies class action for patients of Baltimore gynecologist Dr. Nikita Levy of Johns Hopkins

In an order entered in Baltimore City Circuit Court on Oct. 30, 2013, Judge Sylvester Cox ordered that former patients of gynecologist Dr. Nikita Levy must join a class action against the Johns Hopkins University Hospital in order to preserve their claims. The Order appoints David Haynes, The Cochran Firm, D.C.’s managing attorney, as a member of the plaintiffs’ class action Steering Committee.

If you were a patient of Dr. Levy and are already a current client of The Cochran Firm, D.C., you are included as part of the proposed class action against Johns Hopkins. There are currently 3,800 women who have filed claims against Johns Hopkins, but more than 9,000 patients may be eligible for compensation.

The order is contingent upon settlement negotiations between the plaintiffs and Johns Hopkins University Hospital. While the order is in effect, discovery and pretrial proceedings are stayed until either a settlement is reached or the parties have terminated their settlement negotiations. After six months, the order requires the parties to report the status of settlement negotiations to the court. If no settlement is reached by then, the order will be vacated. The order could help both parties avoid a lengthy and expensive litigation process.

Dr. Levy is accused of secretly photographing or recording his patients without their knowledge. Dr. Levy died in an apparent suicide after allegations against him were made public. A female colleague had reported to Johns Hopkins officials what appeared to be a pen camera hanging from Dr. Levy’s neck. Levy surrendered several recording devices and investigators found images of women stored on 10 hard drives and six file servers he owned.

The amended class action complaint alleges medical negligence, negligence and grossly negligent hiring, retention, supervision, selection, qualification, and credentialing, invasion of privacy, intentional infliction of emotional distress, battery, negligent entrustment, and lack of informed consent.
