Motion to combine federal Androgel lawsuits filed
AndroGel consumers are filing lawsuits nationwide after alleging the testosterone replacement therapy product caused heart problems. Plaintiffs in more than 30 AndroGel lawsuits recently sought to have their cases consolidated in a multidistrict litigation (MDL). Billion-dollar pharmacentural corporations Abbott Laboratories and AbbVie Inc., who designed, manufactured, supplied, and marketed AndroGel, are the defendants in the litigation.
A MDL is a federal legal procedure designed to expedite the process of handling complex cases with multiple plaintiffs that involve common questions of fact. The Judicial Panel on Multidistrict Litigation (JPML) will analyze the AndroGel low-T product lawsuits and decide whether the cases should be consolidated and where to transfer the cases. The JPML has statutory authority to determine whether lawsuits in different federal jurisdictions should be transferred to a single jurisdiction, to select the federal court where the cases may be transferred, and to assign judges to preside over the consolidated lawsuits.
Plaintiffs seeking consolidation of the AndroGel lawsuits against the makers of the product note that each of the cases involve a person who suffered an injury after using the testosterone replacement gel. Injuries include:
- Heart attack
- Pulmonary embolism
- Deep vein thrombosis, and
- Thromboembolic events
The motion seeking to consolidate the AndroGel testosterone lawsuits involve common questions of fact including whether Abbot Labs and AbbVie knew of the dangerous propensity of AndroGel to cause heart problems and whether the warnings they provided were sufficient to alert users to its risks. The plaintiffs seeking consolidation anticipate that thousands of AndroGel lawsuits will be filed in state and federal courts around the United States.
